SACRAMENTO - Today Assemblyman Steven Choi (R-Irvine) announced that his bill AB 677, a measure to provide protection for children who are adopted internationally, passed the Assembly today with zero “No” votes.
Unfortunately, not all children adopted from a foreign country become a United States citizen or even have their adoptions finalized in the states. In situations where an adoption is completed in the foreign country and the child is brought back to California, the adoptive parents must go through a lengthy process known as re-adoption in order to make the adoption final. Many parents fail to ever file these petitions and as a result children are flying under the radar, thus opening the door to potential human trafficking and other abuses.
“For too many, the burdensome re-adoption process is never completed, leaving these children vulnerable,” said Assemblyman Choi. “My office has received multiple reports from personal testimony where adults in their thirties and forties are suddenly surprised to find that they are not legal citizens and are not even holding adoption certificates certified in California. Our system is failing these children, and that is unacceptable.”
This bill seeks to remedy these issues by simply creating a safety net in the current re-adoption system, by ensuring that these adoptees have the initial certification of adoption completed in California. Specifically, the bill adds a new layer of protection by ensuring that if parents fail to file the petition to finalize the adoption, the adoption agency that placed the child will do so on behalf of the child, under the supervision of the Department of Social Services.
“When crafting this legislation, ensuring the safety of the adopted child was my top priority,” continued Choi. “I worked with many legal experts in the field as well as with the Department of Social Services to ensure that our bill, above all else, achieved that goal.”
AB 677 will now go to the Senate.
