Overseas Candlelight Movement Condemns Yoon Suk-yeol’s Declaration of Martial Law and Calls for Immediate Action

“Yoon Suk-yeol Declares War Against the People of South Korea”

In an unprecedented move, President Yoon Suk-yeol of the Republic of Korea has declared martial law, citing political conflicts and governmental paralysis as justification. This declaration does not meet the constitutional requirements outlined in Article 77 of the Korean Constitution and represents a grave threat to the democratic order and the fundamental rights of the Korean people.
We, the Overseas Candlelight Movement, strongly condemn Yoon Suk-yeol’s actions as reckless and barbaric. This is not merely an attempt to manage a political crisis but a violent and tyrannical act aimed at suppressing opposition and concealing his own failures. His actions jeopardize the safety and lives of the Korean people and undermine the hard-fought democracy of the Republic of Korea.





The Problems with Martial Law
1. Abuse of Military Power
Martial law grants the military administrative and judicial authority during extraordinary circumstances. By invoking it for political reasons, Yoon Suk-yeol is risking a return to military authoritarianism, which is wholly incompatible with the values of democracy.
2. Violation of Citizens' Rights
Martial law severely restricts freedoms, including the press, publication, assembly, and association, as well as the legal protections afforded by the warrant system. This is a direct infringement on the fundamental rights of the Korean people.
3. Disregard for the Role of the National Assembly
According to the Constitution, the National Assembly has the authority to demand the termination of martial law if it does not consent. Yoon Suk-yeol’s unilateral implementation disregards this critical check on executive power, exacerbating political turmoil.

Our Demands
* President Yoon Suk-yeol must immediately revoke martial law.
* He must take responsibility for his unconstitutional actions and resign from the presidency.
* The National Assembly must exercise its authority to terminate martial law and protect democracy.
* The Constitutional Court must urgently rule on the legality of martial law and uphold justice.
* Civil society and the international community must join forces to monitor and protect democracy and human rights in Korea.

The Overseas Candlelight Movement stands in solidarity with the people of Korea in this fight against authoritarianism. We will not remain silent as democracy is dismantled. We pledge to support the efforts to oust Yoon Suk-yeol and restore the democratic values that have been the foundation of the Republic of Korea.

We urge global media outlets, civil society organizations, and international communities to shine a light on this urgent crisis in South Korea. The world must not stand idly by as democracy in Korea is eroded by violent and reckless leadership.

Emergency Statement by Overseas Candlelight Movement  

“Yoon Suk-yeol of the Republic of Korea Has Finally Declared War on the People”

This is nothing less than a reckless and barbaric act of violence, far beyond a mere attempt to cover up his own corruption.  
The shocking situation we now face is the result of electing the wrong president.  
Threatening the safety and lives of the people to conceal his own shortcomings is nothing but a betrayal of his duty as a leader.  
We are now witnessing the clear need to overthrow this violent and tyrannical Yoon Suk-yeol.  
However, the people of Korea will not stand by and watch.  
We will take this opportunity to remove Yoon Suk-yeol and restore the democracy that has been broken.  

We, Koreans living abroad, will also stand firmly against this violence, determined to oust Yoon Suk-yeol and protect the democracy of the Republic of Korea, built with the blood of its people.  

Let us all rise together to overthrow the reckless, violent, and barbaric Yoon Suk-yeol!

Statement on the Current Situation
President Yoon Suk-yeol Must Revoke Martial Law and Step Down Immediately

We stand here to protect the constitutional order and democratic values of the Republic of Korea. President Yoon Suk-yeol's declaration of martial law, citing political conflicts and the confrontation between the executive branch and the National Assembly, fails to meet the requirements stipulated in Article 77 of the Constitution and constitutes a grave violation of constitutional order.

The purpose of martial law is to respond to military threats or significant national emergencies. Yet, President Yoon has used political strife and governmental paralysis as excuses to declare martial law, suppressing the fundamental rights of the people and undermining democratic governance. This is an unjustifiable and unconstitutional measure that threatens the very foundation of the Constitution and democracy.

The Problems with Martial Law
1. Risk of Military Intervention in Politics
Martial law is an extraordinary measure where the military partially assumes administrative and judicial authority. Its abuse for political purposes could destroy democracy and pave the way for a return to military dictatorship. President Yoon’s declaration has turned this fear into a reality.

2. Disregard for the Role of the National Assembly
According to the Constitution, the National Assembly has the authority to demand the immediate termination of martial law if it does not consent to its implementation. However, the president has ignored this and unilaterally pursued martial law, further exacerbating political conflict.

3. Violation of Citizens' Fundamental Rights
Under martial law, the freedoms of the press, publication, assembly, association, and the warrant system are severely restricted. This constitutes an oppressive act that infringes on the fundamental rights and democratic freedoms of the people.

Our Demands
-President Yoon Suk-yeol must immediately revoke martial law.
-He must resign from the presidency, taking responsibility for violating the Constitution and abusing his power.
-The National Assembly must exercise its constitutional authority to terminate martial law and protect democracy and citizens' fundamental rights.
-The Constitutional Court must swiftly rule on the unconstitutionality of martial law and ensure justice is upheld.
-Civil society and the international community must unite to support and monitor the protection of democracy and human rights in Korea.

President Yoon Suk-yeol’s martial law is a grave misstep that undermines constitutional order for political purposes. We will fight to the end to safeguard the freedom and democracy of the Republic of Korea. Revoking martial law and the resignation of the president are the only paths to resolving the national crisis and restoring constitutional order.

헌법 제 77조 및 제76조: 국회가 재적의원 과반수의 찬성으로 계엄의 해제를 요구한 때에는 대통령은 이를 해제하여야 한다.

대한민국헌법

[시행 1988. 2. 25.] [헌법 제10호, 1987. 10. 29., 전부개정]

제77조
① 대통령은 전시ㆍ사변 또는 이에 준하는 국가비상사태에 있어서 병력으로써 군사상의 필요에 응하거나 공공의 안녕질서를 유지할 필요가 있을 때에는 법률이 정하는 바에 의하여 계엄을 선포할 수 있다.
② 계엄은 비상계엄과 경비계엄으로 한다.
③ 비상계엄이 선포된 때에는 법률이 정하는 바에 의하여 영장제도, 언론ㆍ출판ㆍ집회ㆍ결사의 자유, 정부나 법원의 권한에 관하여 특별한 조치를 할 수 있다.
④ 계엄을 선포한 때에는 대통령은 지체없이 국회에 통고하여야 한다.
⑤ 국회가 재적의원 과반수의 찬성으로 계엄의 해제를 요구한 때에는 대통령은 이를 해제하여야 한다.


제76조
①대통령은 내우·외환·천재·지변 또는 중대한 재정·경제상의 위기에 있어서 국가의 안전보장 또는 공공의 안녕질서를 유지하기 위하여 긴급한 조치가 필요하고 국회의 집회를 기다릴 여유가 없을 때에 한하여 최소한으로 필요한 재정·경제상의 처분을 하거나 이에 관하여 법률의 효력을 가지는 명령을 발할 수 있다.
②대통령은 국가의 안위에 관계되는 중대한 교전상태에 있어서 국가를 보위하기 위하여 긴급한 조치가 필요하고 국회의 집회가 불가능한 때에 한하여 법률의 효력을 가지는 명령을 발할 수 있다.
③대통령은 제1항과 제2항의 처분 또는 명령을 한 때에는 지체없이 국회에 보고하여 그 승인을 얻어야 한다.
④제3항의 승인을 얻지 못한 때에는 그 처분 또는 명령은 그때부터 효력을 상실한다. 이 경우 그 명령에 의하여 개정 또는 폐지되었던 법률은 그 명령이 승인을 얻지 못한 때부터 당연히 효력을 회복한다.
⑤대통령은 제3항과 제4항의 사유를 지체없이 공포하여야 한다.
